1. Who the contract is with
Your contract is with A Plus Apps, a sole proprietorship (eenmanszaak) registered with the Dutch Chamber of Commerce under number 42117052, established in Rotterdam, the Netherlands, and trading as PollsLive. Full statutory details are in our Legal Notice.
2. Which documents apply
Your agreement consists of the Terms and Conditions, the Data Processing Agreement, the Acceptable Use Policy and the plan description on the pricing page when you buy. Where we sign an Order Form or other agreement with you, it comes first. The Terms set out the order of precedence in full, and terms in your own purchase order or vendor paper apply only if we sign them.
3. Licences and participants
Paid plans are licensed per presenter: each person who builds, runs or presents polls needs their own licence, which may be reassigned when that person leaves the role. People who only answer polls never need a licence and are never charged. Event Passes cover the event day and participant count stated when you buy.
4. Billing, tax and renewals
A Plus Apps is the seller. Payments are processed by Whop, which acts as merchant of record for VAT and sales tax on sales to buyers in the EU, the United Kingdom and the United States. Subscriptions renew automatically; a renewed business subscription runs to the end of the renewed term. If you need a purchase order number or your VAT number on an invoice, contact us before you buy.
5. Data protection
For the content and responses in your workspace you are the controller and A Plus Apps is the processor under the Data Processing Agreement, which applies automatically and does not need to be requested. It covers sub-processor notice, breach notification and deletion at the end of the contract. A Plus Apps is the controller only for your account, billing and support data, as described in the Privacy Policy. Our security measures are described on our Security page.
6. Liability
For business customers the Terms limit our liability to direct damage, require a written notice of default before liability arises, and cap total liability at the fees paid in the twelve months before the event. These limits do not apply to intent or gross negligence of our management. The full wording is in the Limitation of Liability section of the Terms.
7. Governing law and disputes
Dutch law applies. Disputes with business customers go to the District Court of Rotterdam, or, for business customers established outside the EU and the EEA, to arbitration under the rules of the Netherlands Arbitration Institute in Rotterdam.
